Terms of Service

The agreement between you and Authntech Inc. for using Kuest, the AI tutor at kuestai.com, app.kuestai.com and in the Kuest apps for iOS and Android.

Effective 17 min read

In plain English

This summary helps you find your way. The full text below is what applies.

1.This agreement

These Terms of Service ("Terms") are an agreement between you and Authntech Inc. ("Kuest", "we", "us"). They cover the Kuest website at kuestai.com, the Kuest app at app.kuestai.com, the Kuest apps for iOS and Android, our emails, and any other Kuest service that links to these Terms (together, the "Service").

By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service. Our Privacy Policy, Children's Privacy Notice and Cookie Policy explain how we handle personal information. They are part of how we run the Service, so please read them too.

If you are a parent or guardian and you allow your child to use Kuest, you agree to these Terms for yourself and on behalf of your child.

2.Who can use Kuest

Kuest is built for students, and many of them are minors. We ask for your age when you set up your account, and the rules depend on it:

  • 18 or older: you can use Kuest on your own.
  • 13 to 17: you may use Kuest only with the permission of a parent or legal guardian. During setup we ask you to confirm that a parent or guardian knows you use Kuest and agrees to these Terms.
  • Under 13: you may use Kuest only after a parent or guardian gives verifiable consent through our consent process. Until then, the account is limited to finishing setup and waiting for that consent. If a parent does not approve within 30 days, or declines or withdraws consent, we delete the account. Our Children's Privacy Notice explains this in full.

A parent can also set up an account for their child from their own signed-in account. In that case the parent gives consent directly.

You must give your real age. If we learn that a child under 13 is using Kuest without a parent's consent, we will limit the account and delete it as described in our Children's Privacy Notice.

3.Your account

You sign in with a one-time code sent to your email address, or with Google or Apple. We do not use passwords. Keep access to your email and your Google or Apple account secure, because anyone who controls them can sign in to your Kuest account.

  • Give accurate information and keep it up to date.
  • Use one account for yourself. Do not share it or sell it.
  • You are responsible for what happens in your account.
  • Tell us at support@kuestai.com if you think someone else has used your account.

Parents can link to a child's account after the child approves the link. A linked parent sees summaries of the child's learning, such as study time, streaks, subjects and upcoming exams. A parent does not see the child's chats with the tutor. Either side can end the link at any time.

Teachers can share quizzes and flashcards with a class by link or code. A teacher sees each student's first name and last initial and their results on that assignment.

4.Credits and the free plan

Kuest measures usage in credits. Every plan, and every role (student, parent, teacher or other), uses the same credits. Tutor answers, voice conversations, read-aloud, transcription, images, video lessons, podcasts, web search, code runs and the other AI tools all use credits. How many credits an action uses depends on what it costs to run, for example the length of the answer or the AI model that handles it, so it can change when those costs change. The app shows your balance.

Storing files also uses credits: the uploads you keep and the media Kuest generates for you are charged a small amount each day (currently 8 credits per gigabyte per month). If you run out of credits, nothing you stored is deleted.

Credits have no cash value. They cannot be sold, transferred or exchanged for money, and they are not refundable except as described in section 6 or where the law requires.

Kuest Free is available to everyone at no cost. It gives you 6 credits a day. They refill every night at 2:00 a.m. in your time zone, and unused daily credits do not carry over. A new account also gets 50 welcome credits once; they can be used for 30 days. Free also includes small tastes of some paid features, which do not use your daily credits: lecture recordings of up to 15 minutes, one live voice call of up to 2 minutes a week, and 1 short podcast and 1 short mock exam a month. Free also includes 3 answers to a photo or a scanned page a week, which do not use your daily credits.

When your credits are used up, you can wait for them to refill or upgrade. The free plan also has smaller upload limits than paid plans. We may change what the free plan includes. We will tell you in the app before a change that reduces it takes effect.

5.Paid plans and billing

Kuest Plus, Kuest Pro and the Family plan are paid subscriptions. Plus and Family are billed monthly or yearly, and Pro monthly. Prices, and what each plan includes, are shown in the app before you pay. On the web, payments are handled by our payment processor, Stripe. We do not see or store your full card number.

Each paid plan comes with a monthly amount of credits, renewed every month from the day your plan started (also on yearly plans). Unused monthly credits do not carry over to the next month. The amounts are shown in the app; currently Plus gives 500 credits a month and Pro 5,000.

  • Automatic renewal: your subscription renews at the end of each billing period and you are charged the price then in effect, until you cancel.
  • Cancel anytime: you can cancel online in Your profile → Subscriptions in a few clicks, with no need to contact us. Cancellation takes effect at the end of the current billing period, and you keep paid access until then. Until that date you can undo the cancellation. You can also update your payment method and see invoices in the Stripe customer portal linked from Settings.
  • Changing plans: an upgrade applies right away and you pay the prorated difference for the rest of the period. A downgrade takes effect at the end of the current period.
  • Offers: we may offer discounts, for example a first-time discount or an offer when you start to cancel. Each offer shows its terms before you accept it. An offer never stands in the way of cancelling: the button to cancel is on the same screen, and telling us why you are leaving is optional.
  • Failed payments: if a renewal payment fails, we try again over the next few days and you keep your paid plan for 7 days. If it is still unpaid after that, your account uses the free plan until the payment succeeds or the subscription is cancelled. A new month of credits is added only once the payment succeeds.
  • Price changes: we will tell you before a new price applies to your subscription. You can cancel before it takes effect.

Family plan: a parent can buy one plan for up to 4 children. The first child costs the same as Plus, and each extra child adds an amount shown at checkout. The children and the paying parent share one pool of credits each month (currently 500 credits plus 250 for each extra child). Each member can use at most one and a half times an equal share of the pool in a month, and a parent can set a lower limit for a child. Children on a family plan cannot buy top-ups; they can ask the parent, who decides and pays. A parent can change which children are on the plan up to 2 times in each billing period.

Teachers: we may give a teacher whose account our team has verified free access to Plus for a set period, usually 12 months, shown in the app. It is not a subscription and you are never charged for it. When it ends, the account moves to the free plan unless you choose to subscribe.

App Store and Google Play: if you subscribe or buy a top-up in the Kuest app for iOS or Android, the purchase is made with Apple or Google, and their terms and payment rules also apply. They charge you, renew the subscription and handle refund requests. To cancel or change a subscription bought that way, use the subscription settings of your Apple or Google account; deleting the app does not cancel it. Subscriptions bought on the web are managed on the web.

Before you pay, checkout shows these Terms and our refund and cancellation policy and asks you to agree to them.

Top-ups: on Plus or Pro you can buy a one-time top-up pack of extra credits. A top-up is a one-time purchase: it is charged once and does not renew. Its credits are used after your monthly credits run out. A top-up bought on the web can be used for 90 days from purchase, and its unused credits expire after that. A top-up bought in the Kuest app for iOS or Android does not expire. When you have both, credits from web top-ups are used first. If you cancel or move to the free plan, top-up credits you already bought stay usable (until they expire, for web top-ups). A top-up is not refundable once you have started using it, except where the law requires.

Auto top-up: if you are 18 or older and on Plus or Pro bought on the web (not a family plan), you can turn on auto top-up in Settings → Usage. When your credits run low, we then charge the pack you chose to the card saved for your subscription, at most the number of times and the monthly amount you set. It is off until you turn it on, and you can turn it off at any time. If a charge is refused, auto top-up stays off until your next credit month and we tell you in the app and by email.

Pausing: if you cancel a monthly plan bought on the web, we may offer a pause of 1, 2 or 3 months instead. The pause starts at the end of the period you paid for. While it runs, you are on Kuest Free and top-ups you bought stay usable. Your plan comes back, and is charged, at the renewal that ends the pause. You can resume earlier in Subscriptions. App store, yearly and family plans cannot be paused.

Buying for someone else: a parent can buy a plan for a child. The plan is linked to the child's email address and moves to the child's account when they sign in with it. The parent who pays is the customer for billing purposes.

Taxes: prices may not include sales tax, VAT or other taxes. Where tax applies, it is shown at checkout or on your invoice, and you are responsible for paying it.

Minors: a person under 18 should buy a plan only with a parent or guardian's permission and payment method.

6.Refunds

When you cancel, you keep access until the end of the period you already paid for. Cancelling does not by itself give a refund for the current period. If you think you were charged by mistake, or you have another reason to ask for a refund, contact us at support@kuestai.com. We review each request and will answer fairly.

If we refund a top-up, its unused credits are removed. If we refund a subscription payment in full, the subscription ends right away.

Purchases made through the App Store or Google Play are refunded by Apple or Google under their own policies. Ask them first; we cannot issue refunds for those purchases ourselves.

Please contact us at support@kuestai.com before you dispute a charge with your bank or card issuer. Most problems are fixed faster that way.

If you dispute a charge (a chargeback), or your bank reports a payment as fraud, we may:

  • pause paid features and purchases on the account, and on accounts linked to it by device or payment card;
  • end the subscription;
  • remove unused top-up credits and referral bonuses;
  • share the information needed to respond to the dispute with our payment processor and your bank: account and purchase details, your acceptance of these Terms, and sign-in and usage records. We never share the content of your chats.

If the dispute is resolved in our favour or you withdraw it, contact us at support@kuestai.com and we will restore access.

Nothing in these Terms limits any refund or cancellation right you have under the law where you live. For example, if you live in the European Union or the United Kingdom, you may have a right to withdraw from a purchase within 14 days. Where the law allows, you agree that a subscription starts right away and that the refund for a withdrawal may be reduced for the time you already used.

7.Referral program

You can invite friends to Kuest with your personal referral link. To take part, you need an account in good standing and you must be 13 or older. Referrals are turned off for accounts under 13.

How it works:

  • When a friend signs up with your link, your friend gets 100 credits once, on top of the welcome credits. They can be used for 30 days.
  • When your friend verifies their account and completes a first quiz of at least 5 questions within 7 days, you get 100 credits, usable for 90 days. You can get this reward for at most 10 friends in any 30 days.
  • If your friend's first payment is at least $12 for a monthly plan or $60 for a yearly plan (after discounts, before tax), and it is made within 30 days of their sign-up, you get 500 credits at once, usable for 90 days, whether you are on the free plan or a paid plan. If that payment is refunded or disputed within 14 days, we remove the unspent part.
  • There is no limit on how many friends you can invite.
  • Referrals made before these terms took effect keep the rules they were made under.
  • Bonuses have no cash value and cannot be transferred, sold or exchanged.

Not allowed:

  • referring yourself;
  • creating or using more than one account;
  • referring accounts shared with you or created on your own device or with your own payment card;
  • using fake or throwaway email addresses;
  • paying for a friend's plan to earn a bonus;
  • spam, or misleading promotion of Kuest or your link.

We may review, hold, refuse or remove a bonus, and suspend or lock the accounts involved, if we see abuse or fraud. Fraud means losing your bonuses and may lead to your account being suspended. If a payment is refunded or disputed, the bonus it earned is removed.

We can change or end the referral program at any time. A change does not take away a bonus that is already active, unless it was earned through abuse.

8.Acceptable use

Use Kuest to learn and to teach. Do not:

  • break the law, or help anyone else break it;
  • harass, bully, threaten or harm anyone, including other students;
  • upload content that is sexual, hateful, violent or otherwise harmful, or any sexual content involving minors;
  • share other people's personal information without their permission;
  • upload content you do not have the right to share;
  • try to get around usage limits, age checks, parental consent or security measures;
  • use bots, scrapers or automated tools to access the Service, or resell it;
  • try to extract our models, prompts, source code or data, or probe, disrupt or overload our systems;
  • pretend to be someone else, including a parent or teacher.

We limit how often certain actions can be taken to keep the Service fair and working for everyone.

9.Academic integrity

Kuest is a tutor. It is designed to help you understand, not to do your work for you. By default it guides you step by step with questions and hints.

  • Do not hand in work produced by Kuest as your own.
  • Follow your school's and your teachers' rules on using AI. If they do not allow AI help on an assignment or test, do not use Kuest for it.
  • Do not use Kuest during an exam or assessment unless you are allowed to.

You are responsible for the work you submit.

10.AI has limits

Kuest's answers, lessons, quizzes, podcasts and other materials are generated by artificial intelligence. AI can be wrong, incomplete or out of date, even when it sounds sure.

  • Check important answers against your textbook, teacher or another trusted source.
  • Kuest does not guarantee any grade, score or exam result.
  • Kuest does not give medical, mental health, legal, financial or other professional advice. Talk to a qualified professional for those.
  • If you are in crisis or in danger, contact a trusted adult or emergency services. In the US, call or text 988, or call 911 in an emergency.

11.Your content

You keep ownership of what you put into Kuest: your messages, questions, uploads, notes, recordings and the materials you create with it ("your content").

You give us a limited, worldwide, non-exclusive, royalty-free licence to host, store, copy, process and display your content only to run, secure and improve the Service for you. This includes sending it to the service providers that power Kuest, such as the AI model providers that generate answers. The licence ends when you delete the content or your account, except for copies we must keep by law or that remain for a short time in backups.

If you share something, for example a challenge link or a shared exam prep, anyone with the link can see what you shared. Students under 13 cannot create public share links.

You are responsible for your content. Make sure you have the right to upload it. We may remove content that breaks these Terms.

12.Our property

The Service, including its software, design, text, graphics, logos and the Kuest name, belongs to Authntech Inc. or its licensors and is protected by law. We give you a personal, non-transferable, revocable right to use the Service under these Terms. You may use materials Kuest generates for you for your own learning and teaching.

If you send us feedback or ideas, we may use them without any obligation to you.

13.Third-party services

Kuest relies on other companies, such as Google and Apple for sign-in, Stripe, Apple and Google for payments, and AI model providers for answers. Kuest may also show links to websites, for example sources found by web search. Those services and websites have their own terms and privacy policies. We are not responsible for them.

14.Suspension and termination

You can stop using Kuest at any time. You can delete your account in Settings. If you have an active subscription, cancel it first. Deleting your account removes your chats, lessons, progress and uploads and cannot be undone.

We may suspend or close your account if you seriously or repeatedly break these Terms, if you dispute a payment or a payment is reported as fraud, if we see fraud or abuse of the referral program, if the law requires it, or to protect students, other users or the Service. When we can, we will tell you why and give you a chance to respond. If we close a paid account without a good reason under these Terms, we will refund the unused part of your subscription.

While a payment is being reviewed, purchases on the account may be paused automatically. We lift the pause as soon as the review is done.

We may change or stop parts of the Service. If we shut down the Service entirely, we will give reasonable notice and refund any prepaid, unused subscription time.

15.Disclaimers

We work hard to keep Kuest accurate, safe and available, but we provide the Service "as is" and "as available". To the extent the law allows, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy and non-infringement. We do not promise that the Service will be uninterrupted or error-free.

Some places do not allow these disclaimers. In those places they apply only as far as the law allows, and you keep all rights that cannot be waived.

16.Limitation of liability

To the extent the law allows, Authntech Inc. is not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, data or goodwill, arising from your use of the Service.

To the extent the law allows, our total liability for any claim about the Service is limited to the greater of the amount you paid us in the 12 months before the claim, or 100 US dollars.

These limits do not apply to liability that cannot be limited by law, such as liability for death or personal injury caused by our negligence, or for fraud.

17.Indemnity

If you are an adult and you misuse the Service or break these Terms, and a third party makes a claim against us because of it, you agree to cover our reasonable losses and costs from that claim, to the extent the law allows. This section does not make a parent or guardian responsible for their child's actions beyond what the law already provides, and it does not apply to minors.

18.Resolving disputes

Talk to us first. Most problems can be solved quickly. Before starting any claim, email support@kuestai.com or write to us at 1007 N Orange St., 4th Floor, Ste 1382, Wilmington, DE 19801, USA, describe the problem and what you would like us to do. We will try to resolve it with you within 30 days.

These Terms are governed by the laws of the State of Delaware, without regard to its conflict-of-law rules. If we cannot resolve a dispute informally, either of us may bring it in the state or federal courts located in Delaware, or in a small claims court where you live if your claim qualifies.

If you are a consumer outside the United States, you also keep the protection of the mandatory laws of the country where you live and may bring a claim in your local courts.

19.Changes to these Terms

We may update these Terms as Kuest changes or the law changes. We will post the new version on this page with a new effective date. If a change is important, we will tell you in the app or by email before it takes effect, and we will ask you to accept the new version in the app before you continue. For other changes, if you keep using Kuest after the change takes effect, you accept the new Terms. If you do not agree, you can stop using Kuest and delete your account.

20.General

  • These Terms, together with the policies they mention, are the whole agreement between you and us about the Service.
  • If a part of these Terms cannot be enforced, the rest still applies.
  • If we do not enforce a part of these Terms right away, we can still enforce it later.
  • You may not transfer these Terms to someone else. We may transfer them as part of a merger, acquisition or sale of assets, and we will tell you if we do.
